The scammers are back!  Remember that the Sheriff’s Office will never ask you to purchase Green Dot Money Cards for fines for failing to appear for jury duty.  If you are fined for failing to appear for jury duty, it will only be after you have appeared in front of a judge and given an opportunity to explain your non-appearance.  Be sure and check suspicious phone calls by calling the appropriate office.  Do not give your bank account information, credit card information or social security number to anyone over the phone that you do not absolutely know.  This is true even though it may sound like a dire emergency. Protect yourself.

NEWS FROM THE COURTHOUSE ANNEX

At the request of a Customer the District Clerk’s Office has modified its on-line juror program providing an electronic means to seek exemptions and offer disqualifying information.  When you use the on-line form you will receive a receipt with a unique identifier that will tell you whether your exemption or disqualification has been accepted or if someone will be contacting you.  You may print-out the receipt for your records.

NEWS FROM THE COURTHOUSE ANNEX

As of September 1, 2014 Rule 902(10) of the Texas Rules of Evidence is amended by the Supreme Court and the Court of Criminal Appeals.  The change in the rule was instructed by the legislature in the last session.  Business Records Affidavits are no longer filed with the clerk in order to admit them into evidence for cases filed after September 1, 2014.  The party wishing to admit the record must serve it on the other party or parties in accordance with the rules.

REMINDER:  July 1, 2014 all attorney must eFile pleadings to the District Clerk and County Clerk.  Be sure and check the business process for the District Clerk prior to eFiling.  Read it all. Do your best to read the material and the web site for the eFile vendor prior to eFiling.  If you are desperate call and we will try to assist.  Remember it has not killed anyone yet…

NEWS FROM THE COURTHOUSE ANNEX 

eFiling training for McLennan County will occur on May 1, 2014.  Three EFSPs have agreed to appear to demonstrate filing through their eFiling portals.

Presentations will be made for the County and District Clerk eFiling procedures.  There will be a discussion of the Supreme Court Rules and the JCIT Tech standards.

 The Supreme Court adopted new technology standards for eFiling March 21, 2014.  This is the 3rd version of the Technology Standards.  It will probably change the appearance of the document types on the eFIling Services.  We will know more once the Electronic file manager begins programming the system.  You may find the standards here.

NEWS FROM THE COURTHOUSE ANNEX 

The District Clerk’s Office was notified today that a debt collection scam is using the District Clerk’s phone number and a reference to the District Court to confuse people into believing that the McLennan County is calling you.  The party represents himself or herself as the McLennan District Court’s locator service and a local number appears.  You are asked to return the call to an (800) number.  The McLennan County District Clerk’s Office only collects court costs, fees and fines owed to McLennan County as a result of a court case.  This office never asks for Social Security Numbers, birthdates, credit card numbers or other similar personal identifying information.  Do not provide any such information over the phone to anyone who “sounds” official.  If you are unsure about a call from this office check with the McLennan County District Clerk’s Office about the contact by calling 254-757-5054 or 254-757-5057.  Sorry we do not have an (800) number.  This is called “spoofing”.

The District Clerk’s Office can now offer you a complete copy of the documents from a case file in digital format for those instruments that are scanned in the imaging system.  If you furnish a flash drive or cd or dvd, we will make you a copy of the case file for $20.00. Or you can simply request that we email the file to you.   If there are 7 or more instruments in the case file then you save money over our regular fees of $3.00 per digital document.

Today the McLennan County District Clerk’s Office switched from tex.gov to TexFile for eFiling pursuant to rules of the Supreme Court and the Office of Court Administration.  To find out more information concerning the new eFiling processes and requirements go to the E-Filing button on the main web page for the District Clerk.

On August 27, 2013 after a public hearing the Commissioner’s Court of McLennan County approved the Document Preservation Plan of the McLennan County District Clerk.  You may obtain a copy here.

NEWS FROM THE COURTHOUSE ANNEX 

 

              The Texas Legislature has increased certain fees effective 9-1-2013: 

1)    A $20.00 fee will be added “on the filing of any civil action or proceeding requiring a filing fee, including an appeal, and on the filing of any counterclaim, cross-action, intervention, interpleader, or third-party action requiring a filing fee.”  The Office of Court Administration interprets this fee to exclude those actions filed under §110.002 Family Code and those actions in IV-D cases filed by the Office of Attorney General. 51.851(b) Tx Gov’t Code

2)    A $5.00 fee will be added to the court costs of all persons convicted of a felony or misdemeanor in District Court for an offense committed after 9-1-2013.  51.851(d) Tx Gov’t Code

NEWS FROM THE COURTHOUSE ANNEX  

The District Clerk’s Office is moving forward with its civil division paperless project.  The belief is that the office should start slowly and work out any difficulties.  Beginning March 1, 2013 the office will scan, perform quality control review and discard the following documents: instruction letters from counsel, original issuances, request for issuances, Notices of Appealable Orders (Civil and Family), New Suit Forms, Certificates for Seminar for Divorcing Parents, Notices for People Filing Family/Civil Suits Without a Lawyer, Certificates of Deposition, Certificates of Discovery, Motions to Withdraw as Counsel, Motions to Substitute as Counsel, Subpoena Applications, and Affidavits of Indigency.  These instruments will be scanned and maintained in the iDocket system.  All courts have access to these documents and there are 5 public access stations outside of the office.  These systems are backed-up in two different ways with storage at two different facilities.  All documents will continue to be noted on the docket sheet.  This means that may appear on an index to a file.  This will assist you in locating them on the event screen in the iDocket system.

For individuals summoned as jurors you may now re-schedule, claim an exemption or certify to a disqualification by using our on-line form.  Click on the Juror button on the District Clerk’s webpage and then proceed to “Claim Exemptions/Disqualifications or Re-Schedule”.  If you fill out the form completely and accurately it will save you a trip to the courthouse.
